As previously reported by CrimeOnlineMadison County Police found 10-year-old Tate Buening and his father, Brian Buening, dead inside Buening’s home in Harvest on August 6. A month earlier, Tate’s mother, Kayla White, filed an emergency protective order against Buening in Madison County Circuit Court, citing extreme fear for the safety of her son, who was scheduled for a visitation ordered by the court with Buening.

An Alabama mother questions the way the police handled her son’s case after an officer reportedly refused to see how her son was doing, who was later found dead inside his father’s home. The judge scheduled the hearing for a month later, on August 9.

On the day she found her deceased son, Kayla White contacted the Madison County Sheriff’s Office to have his well-being reviewed. White waited outside Buening’s home to call for help, but when the responding officer arrived, she did not knock on the door, forcing her to enter, where she found Tate and her father dead from gunshot wounds, in an apparent murder. -suicide.

The case is now dismissed after Buening “carried out his threats and committed suicide and the minor.” White, however, is fighting for justice.

Will League, an attorney representing White, told the outlet that the officer put White in an unsafe situation by allowing her to knock on the door of her ex, who had allegedly threatened to kill her a few days earlier.

“To be fair, the officer did not know there was a threat to his life, but by bringing the mother up, he puts himself in a dangerous position by knocking on the door of someone who threatened to kill her a few days earlier,” League said.

“They roll into domestic scenes every day. Some of the more dangerous calls they make and if they can be armed with more information as they get there and if the system can be modified so that they can access the orders or documents that are already in the system. The White family now plans to file a lawsuit against the shooter’s estate. I don’t know how to go on with this.
