David Poncurak, 43, pleaded guilty to aggravated vehicular assault and other charges in Westchester County court Tuesday in the chilling accident captured on video on July 23, prosecutors said in a news release. A drunk driver who crashed into a Yonkers mother and pinned her 8-month-old baby under her car inside a local barbershop could now face up to 15 years in prison.

“I applaud the extraordinary work of the Yonkers Police Department, bystanders, and the ambulance team that stepped into action to help during this heartbreaking event,” Rocah said. “The victims are alive today thanks to the heroic efforts of these brave individuals.” The unsuspecting mother was crossing the street with her baby around 8:30 a.m. when the Hyundai collided with a parked car on Lake Avenue, fired across the street, and slammed into her and the baby, footage from surveillance of the incident.
They were thrown into the nearby barbershop, where Yonkers police officers, Rocco Fusco and Paul Samoyedny, and others, removed the baby trapped under the car. The mother, who has not been publicly identified, underwent surgery for a fractured femur at Jacobi Medical Center in the Bronx and her daughter suffered a skull fracture and server burns.
In addition to the felony vehicular assault charge, Poncurak also pleaded guilty to the misdemeanors of drunk driving, drug and alcohol-impaired driving, and driving without a license. He faces five to 15 years in prison when sentenced on January 13.
