‘My duty as a law enforcement officer in considering whether sentences can be unduly lenient is to act independently of the government, even when it is not easy or popular. “Having received detailed legal advice and considered the issues raised very carefully, I have come to the conclusion that Cashman’s case cannot properly be referred to the Court of Appeal.

‘Such a referral can only be made if the rigorous legal test is met, regardless of the seriousness of the offense or the emotions the offense may evoke. The threshold for referral is high and was not met in this case.

‘The test is met only if the sentencing judge made a serious mistake or imposed a sentence outside the range reasonably available in the circumstances of the offense.

“My thoughts remain with Olivia’s family and friends who have shown immeasurable strength during this devastating time.” Cashman, a high-ranking drug dealer from Liverpool, has lodged his own appeal against his sentence, with lawyers arguing that the sentence is too harsh.

He was branded a “coward” for refusing to appear in court and confront Olivia’s family after he was found guilty by the jury and was about to be sentenced by Magistrate Judge Yip in the Crown Court of Manchester. He has prompted calls for a change in the law to force offenders to attend their sentencing hearings or face additional years in jail.

Cheryl Korbel, Olivia’s mother, joined a chorus of voices, including former Justice Secretary Dominic Raab and Labor leader Sir Keir Starmer, calling for a change in the law. Cashman’s trial heard how he ‘waited’ with two guns to attack Joseph Nee, 36, a convicted drug dealer.

After shooting Nee, his victim tried to escape, running towards the Korbels’ front door, opened by Cheryl, who had come out to see what was going on. As she tried to block Nee’s door, a frightened Olivia ran from her bed to the stairs, yelling, ‘Mom, I’m scared!’
