Wyatt Dean Lamb, a suspect in the death of 2-year-old Athian Rivera, has been charged with the boy’s murder, the Laramie County district attorney’s office announced Monday afternoon.
Lamb is charged with first degree murder and 10 felonies of child abuse with injuries. His case is scheduled for a preliminary hearing at 9 a.m. Aug. 6 in Laramie County Circuit Court. After an initial appearance Tuesday morning, his bail was set at $ 1 million.
Lamb was arrested in February for violating bail conditions in a separate case, and has been held without bond in the Laramie County Jail since March and is awaiting trial in that case.
“I commend the Cheyenne Police Department, the Laramie County Coroner, and the Wyoming State Crime Lab for their collective efforts in this case,” Laramie County District Attorney Leigh Anne Manlove said in her statement from Monday email to the media.
Athian was reported missing by his mother, Kassandra Orona, around 1 p.m. February 19th. Her body was discovered around 3 p.m. in a garbage container located just outside the entrance to Orona’s apartment, located in the 400 block of Desmet Drive.
The boy died of brain swelling with a hernia potentially caused by blunt trauma, oxygen restriction or both, according to a probable cause affidavit filed Monday in Laramie County Circuit Court.
Laramie County Coroner Rebecca Reid determined that Athian died between 11 a.m. and 1 p.m. February 19th. His body was wrapped in a fitted sheet and blanket, which were inside five black plastic garbage bags, according to the affidavit.
Forensic pathologist Dr. James Wilkerson noted “scattered blunt force injuries over much of the body,” including multiple bruises and abrasions, as well as burn marks on the genitals, upper legs, and area of the neck. the child’s groin, matching a flashlight found in Orona’s apartment. according to an autopsy performed by Reid and Wilkerson.
Wilkerson issued the autopsy report, signed May 6, which ruled that Athian’s death was a homicide. Orona was interviewed by a Cheyenne police detective at 4 p.m. On February 19, and again on February 20 and 22. He said that he lived in the apartment with Athian and hers two other young children of hers, and that Lamb had moved into the apartment with them in August 2020.
Orona told a detective that he had to be at work by 5:30 p.m. February 18 and he left the three children in Lamb’s care, as he used to do at work. He communicated with Lamb throughout his shift. At one point, Lamb told him that Athian had vomited and was coughing. She told Lamb to keep an eye on the boy and that she would take him to the doctor in the morning, she said.
He came home at 3:30 a.m. and she went to see how the children were, who slept together in the same bed, as they used to. As she put a blanket over them, she said Lamb turned off the hall light and couldn’t see. When she asked what she was doing, she turned the light back on and walked away from her.
Orona then smoked marijuana with Lamb in her room until about 4:30 a.m., when they both fell asleep.
The next morning, Orona said, Lamb asked her if they had clean sheets. She said that she wanted to change the children’s sheets because Athian had vomited before, that she would take care of him and she would not worry about getting up. Orona told the detective that Lamb was “being nicer than normal.”
Around 8:30 a.m., Lamb asked Orona to take her daughter to Goins Elementary School because she was concerned that she would be late. The three left the apartment, leaving behind Athian and her brother, who were still in bed.
Orona said she and Lamb returned to the apartment around 8:40 a.m. and they smoked marijuana together. Athian’s brother was awake, but Orona said that she did not see Athian and believed that he was still asleep. Orona went back to bed at 9:30 a.m.
While she was in bed, Orona said that Lamb was going to do the housework and that she overheard him opening garbage bags at one point.
At about 12:15 p.m., Orona said Lamb woke her up and told her that Athian had disappeared and that the door to the apartment was open. Orona said she panicked and searched the interior and exterior of the apartment, separating from Lamb while they were outside looking.
Orona said the apartment complex’s maintenance guy helped her find Athian, and her property manager encouraged her to call the police, which she did around 1 p.m. Lamb then left the apartment due to an outstanding arrest warrant, but returned around 1:30 p.m. while detectives interviewed Orona.
Lamb told detectives that she lived in the 2500 block of Deming Drive with a roommate. She said that she was with the children on February 18, starting at 3:30 p.m., and that Orona left for work at 5:30 p.m. She said that she put Athian and her brother to bed around 8 p.m., and that Athian vomited once during the night. A school resource officer interviewed Orona’s daughter around 3 p.m. at her school. The girl said that her mother and her mother’s friend, “Wyatt,” had taken her to school that morning and left her siblings at her house because they were sleeping. She said Athian had vomited at some point in the night.
Surveillance video from the elementary school obtained by police showed Lamb, Orona, and the girl arriving at Orona’s vehicle around 8:40 a.m. February 19.
A city of Cheyenne garbage truck operator confirmed that he emptied the garbage container near Orona’s apartment around 12:35 p.m. The police secured and sealed the dumpster in which Athian was found and took it to the police department.
During a search of Orona’s apartment at 7:32 p.m. On February 19, detectives found a roll of black plastic garbage bags that matched the bags Athian was found in, along with other sheets that matched the one she was wrapped.
