John Haubert, an Aurora police officer, struck an unarmed man with a pistol and strangled him during the arrest, body camera footage shows.

Officers Haubert, Francine Martinez face criminal charges in connection with the incident.

Haubert and Martinez were dispatched at 2:16 p.m. Friday on a report of a trespasser in the 3100 block of South Parker Road and contacted three people who were sitting on a nearby sidewalk. Affidavits state.

After Martinez learned that the three people had felony warrants, they tried to arrest them. Two of the men fled.

According to the affidavits, Haubert drew his pistol and pointed it at the third suspect named Kyle maurice vinson, despite the fact that he had his hands up and had not run away or shown any signs of physical resistance. According to the affidavits, the man turned around as ordered, and Haubert grabbed him by the nape and squeezed the man’s head with the barrel of his gun.

Haubert then attempted to handcuff the man, who denied having a warrant and tried to avoid the handcuffs. According to court records, Haubert climbed on top of him and grabbed him by the side of the neck. According to the affidavits, Haubert hit the man on the head with his gun at least seven times while telling him to lie on his stomach.

The man repeatedly told Haubert, “You’re killing me,” according to the affidavits. Haubert then grabbed the man by the front of the neck and forced him to the ground and strangled him until he had trouble speaking, according to the affidavits.

“If you move, I’ll shoot you,” Haubert told the man, according to the affidavit.

The man “was not hitting, hitting or kicking Officer Haubert” and was not taking any action that threatened the officers’ lives, according to the affidavits.

The man began to lose consciousness during the 39-second strangulation and began to cry.

Two other officers arrived at the scene and one of them, Officer Michael Dieck, used his Taser on the man.

The suspect was hospitalized after his arrest with visible head injuries. He had to have stitches to close some of the wounds on his head.

This week, Haubert, 39, was arrested on charges of assault with a deadly weapon causing serious bodily injury, a second count of felony strangulation, threatening felony and official misconduct, and official oppression, both misdemeanors.

Martinez, 40, faces one count for failing to intervene and a second count for failing to report the use of force.
