Theoharis Lekas of New Jersey, filed a lawsuit Friday in New York Supreme Court alleging that the resort was negligent in failing to post signs recommending footwear. A New Jersey man is suing the Trump International Beach Resort in Florida after losing a toe and part of it to third-degree burns caused by hot pool decking and beach sand.
He claimed surfaces inside the complex were “hot” during his August 2022 vacation, causing “devastating” third-degree burns to both feet. Lekas said he couldn’t feel his feet burn as he walked on the blistered pool deck because he suffered from diabetic neuropathy, which “caused him to lose feeling in his feet.”
Lekas is suing the Sunny Isles resort for an undecided amount, alleging that her weekend visit “irrevocably and seriously damaged” his life. Bill Matsikoudis, whose firm represents Lekas, told DailyMail.com that the sum of the damages sought would likely be “in excess of $1 million“.

The complex is not directly owned by former President Donald Trump but is instead under the umbrella of The Trump Organization, of which he is the founder and majority owner. However, the lawsuit claims that the resort “advertises its collaboration” with the real estate mogul.
Lekas alleged that he suffered severe, life-changing burns because the resort was “negligent” and “failed to post signs or any other warning” over the sweltering surfaces. He also accused Trump International of failing to mitigate the temperatures by laying down mats or spraying the floors with water.
After walking around the resort during his weekend stay, Lekas said he only noticed his peeling feet on the last day of his trip when he put on his socks. Upon returning home, the lawsuit states that his condition deteriorated to the point that he had to quickly bandage his severely burned feet and rush to the hospital.
As his left foot healed, the severe burns caused his right foot to develop a “bullet hole-shaped ulcer” that “grew wider and deeper, down to the bone.” Lekas claimed that his foot swelled to the size of a football, while one of his toes also turned black and became gangrenous.

The ordeal resulted in doctors amputating his foot at the end of a second 16-day stint in the hospital. The lawsuit added that the wound remains unhealed, posing a significant threat to his health and that he “has been told to expect further surgeries.” Lekas argued that the resort owed him a duty of care to prevent “even unusual dangers.”
The lawsuit, brought by Matsikoudis & Fanciullo LLC, claims an amount that has not yet been ‘set by the court’ and claims it was filed with the Supreme Court because the amount will exceed jurisdictional limits that could be imposed by lower courts.
Lekas asserted that he continues to suffer damages that include bodily injury, pain and suffering, mental, emotional, and physical anguish, loss of income, and substantial medical expenses.
Bill Matsikoudis, whose firm represents Lekas, told DailyMail.com: “The lawsuit speaks for itself: the resort was negligent.” “We hope that the damage will not increase,” added Matsikoudis.
