Roberta Kaplan is an American attorney who specializes in commercial litigation and matters of public interest. She was a co-founder of the Time’s Up Legal Defense Fund and is an Adjunct Professor of Law at Columbia University School of Law. She was a partner at Paul, Weiss, Rifkind, Wharton & Garrison before starting her own company in 2017.

Time’s Up Legal Defense Fund President Roberta Kaplan resigned from the organization on Monday, August 9. He faced strong criticism for his ties to the governor. Andrew Cuomo and his alleged efforts to discredit one of his accusers. Kaplan was referenced in the report released last week by Attorney General Letitia James that accused Cuomo of se**xually harassing 11 women.

According to the investigators’ report, Kaplan had reviewed a draft opinion letter attacking Lindsey Boylan, who was the first woman to publicly accuse Cuomo of se**xual bullying. Kaplan’s law firm represented Cuomo’s senior advisor Melissa DeRosa during the attorney general’s investigation. She told Time’s Up in her resignation letter that she was unable to answer questions about Cuomo or DeRosa as a practicing attorney.

Kaplan said in the resignation letter: “Therefore, I have reluctantly concluded that active legal practice is no longer compatible with serving on the Board at Time’s Up at this time and I hereby resign.” Kaplan also mentioned in his resignation letter the seriousness of the attorney general’s findings. “Unfortunately, recent events have made it clear that even our apparent allies in the fight for the advancement of women can become abusers,” she said.

According to investigators, DeRosa led efforts to discredit Boylan. It is important to note here that DeRosa resigned on Sunday, August 8. DeRosa reportedly told investigators that Kaplan had reviewed the letter about Boylan and was “okay with some changes.” “The draft letter or opinion piece attacking Ms. Boylan, particularly when combined with the disclosure of confidential internal records to the press, constitutes retaliation,” the investigators’ report said. However, the opinion letter was never published.

Kaplan’s resignation comes the same day that one of Cuomo’s former aides, Brittany Commisso, who brought the most serious allegations against him, made the charges public in a new interview. She claimed that Cuomo had groped and hugged her in search of “personal se**xual satisfaction” and had turned her “dream job … into a nightmare.” Commisso explained what she called “unwanted touching” during “creepy encounters” with Cuomo. Brittany Commisso started working for Cuomo in 2017.
