A decorated former special forces soldier is facing life in prison after becoming the first current or former member of the Australian Defense Force to be charged with war crimes under Australian law. Oliver Schulz, 41, was arrested Monday morning by Australian Federal Police in the southern highlands of New South Wales. The AFP said in a statement that Schulz will be alleged to have murdered an Afghan man while he was deployed in Afghanistan with the ADF.

Schulz was charged with one count of war crime: murder, which carries a maximum penalty of life in prison. AFP said he was charged in Cooma, through the Queanbeyan Local Court, on Monday afternoon. Video footage broadcast by ABC allegedly showed him shooting an Afghan man in a wheat field in Uruzgan province in southern Afghanistan. Schulz, who received the commendation for his bravery for his service in Afghanistan, was removed by the ADF after the episode aired. Police said the arrest was the result of a joint investigation with the Office of the Special Investigator, which is looking into allegations stemming from the Brereton Report into alleged war crimes committed by ADF personnel during the war in Afghanistan.

Chris Moraitis, the office’s director-general, told Senate estimates last month that his agency was investigating “between 40 and 50” alleged crimes committed by Australian special forces soldiers during the war in Afghanistan. Schulz has been remanded in custody, with his next hearing scheduled for May 16 at Sydney’s Downing Center Local Court.

The Brereton inquiry, delivered in November 2020, recommended that 23 incidents and 19 people be referred for further investigation by police. The inquiry recommended that any suspected war crimes be tried by a civilian criminal court in a jury trial, rather than a military court. Murders are considered war crimes if the victim was a non-combatant or incapacitated due to injury and if the perpetrator was reckless in doing so. Killings do not constitute war crimes if they occur as part of an attack on a military objective, in which the perpetrator did not expect excessive civilian casualties.

Fiona Nelson, director of legal advocacy at the Australian Center for International Justice, said the organization welcomes the news that the investigations have resulted in an arrest. “For decades, victims of human rights violations in the Afghanistan conflict have been denied accountability,” she said. “Criminal proceedings in Australia have an important role to play in finally allowing impunity to be challenged.”
