What happened at East Lake Middle School

The mother of an East Lake Middle School student has sued the school for forcing her daughter to be strip-searched by a vape. According to the lawsuit, the eighth grader’s mother claimed another student approached her and asked if she wanted to smoke a new vape.

The student’s mother also said the girl declined the offer but allowed the other student to leave the vape in her locker. After this, the girl was taken out of the classroom and questioned about the vaporizer. It was also alleged that the school principal also questioned her before asking some of her staff to search her.

The alleged incident took place on September 7, 2022, and the lawsuit was filed in the US District Court for the Northern District of Ohio on December 28, 2022.

The mother alleged that the East Lake Middle School student was suspended despite nothing being found after the strip search.

The mother of the East Lake Middle School student said the nursing assistant was asked to strip the girl naked. Also, the assistant was not trained, but was asked to perform the search anyway.

The girl’s mother also said that although authorities and staff at East Lake Middle School found nothing after the strip search, the girl was still suspended.

The lawsuit also claimed that East Lake Middle School officials acknowledged that the strip search was “inappropriate.” The complaint filed by the mother was against the Willoughby-Eastlake City Schools Board of Education and the school employees involved in the strip search.

Jared Klebanow, the attorney representing the student’s mother, said:

“Students don’t check their constitutional rights at the door when they enter the school. Subjecting a teen to a strip search for an item that did not pose a threat of violence to students or staff was unreasonable and violated her civil rights.”

The lawyer also stated that his first priority was to make sure that the same thing did not happen to another student. He added that the girl’s damages are still being assessed.

In addition, the attorney stated that the complaint mentions that the school violated the student’s constitutional rights, namely the Fourth and Fourteenth Amendments to the United States Constitution.

The lawyer said:

“Students and parents need to be able to trust that public school districts and the adults who work within those districts will do everything they can to protect the rights of our students, not violate those rights.”

He added:

“In this instance, the district and every single adult involved in this case failed. People say that time heals all wounds, but it is important to remember that there is almost always a scar.

The lawsuit also alleges that the student’s locker was also searched. However, during the search, the principal and staff at East Lake Middle School found nothing inappropriate or illegal.

At this time, neither the school nor the principal have responded to the claims made by the parents in their lawsuit.
