Transcripts obtained by the outlet revealed that the officers did not mention anything to the judge about Ruggs’ intoxication. However, they reveal that the officer tells the judge that Ruggs had been driving at a ‘high rate of speed’ and weaving in and out of traffic before the accident.
“A bona fide police officer who called the judge for the warrant gave very, very few facts to support probable cause that he was incapacitated,” Wolfson said. Had the blood evidence not been presented as evidence at trial, prosecutors would have been left with a reckless driving charge, which could have given Ruggs the possibility of parole.
“Field sobriety tests were not administered the night of the accident because Ruggs was transported to a hospital due to his injuries,” a Metro spokesperson told the outlet.
