At one point, another passenger on the train was heard asking about the strangulation, to which the anonymous black man said that Penny “isn’t squeezing” Neely.
But the off-screen passenger says that Neely can choke on his own saliva, to which the black assailant and Penny agree. They then all freed Neely and decided to put him on his side, but the 30-year-old homeless man appears to be limp and not moving.
But only Penny was arrested afterward, after turning herself into authorities. He was released on $100,000 bail and has yet to plead guilty.
