A viral video of Neely’s strangulation death shows an unknown black man in a black jacket holding onto Neely’s arms as he tried to fight his way out of Penny’s grasp. Penny, meanwhile, had her arms wrapped around the man’s throat and over his head.
Soon another white man, dressed in a leather jacket and jeans with a black backpack, approached them. He then knelt down and shoved Neely’s right shoulder in another effort to subdue the bum. At one point, another passenger on the train was heard asking about the strangulation, to which the anonymous black man said that Penny “isn’t squeezing” Neely.
But the off-screen passenger says that Neely can choke on his own saliva, to which the black assailant and Penny agree. They then all freed Neely and decided to put him on his side, but the 30-year-old homeless man appears to be limp and not moving.
But only Penny was arrested afterward, after turning herself into authorities. He was released on $100,000 bail and has yet to plead guilty. Those who know Penny describe him as a “cute guy” and “fun”, who grew up in a middle-class military family on Long Island. “He was always there for his family and his sisters,” Baldwin said. ‘Danny has always been quiet, he comes from a quiet family.’

He added that “he could always count on his cousin when you needed help.” Neighbors reportedly added that Penny even lived out of a van at one point and that he had previously shared a three-bedroom house with his three sisters and her parents before they divorced.
“Danny was always funny and goofy and he never hurt anybody,” said the Marine’s childhood friend, Devin Marino. “He was always super inclusive,” he added. “His family was very nice and he had an open-door policy.” In high school, his friends and family said that Penny was a star lacrosse player.
But after her parents’ divorce and her time in the military, they said, Penny took time to figure out her life. He dropped out of college to spend time backpacking Central America, he wrote on Harri, a hospitality industry job website he was using to find a bartending position in Manhattan.
“Growing up here in New York, I have always been inspired by ambition and courage,” Penny posted on the website. ‘After high school, I wasn’t sure about my future, I enlisted in the Marine Corps looking for adventure. “While serving as a squadron leader on two deployments, I began to realize what I was passionate about.”
